Question:

I let my step dad borrow my car he wrecked the ins. paid it off do i have any options to get $ from him 4 new?

I was being a nice person letting him drive my car back and forth to Indiana for work. since all he had was a big Ford Diesel. He wrecked my car the insurance paid it off, He left me to pay the $500 deductible and is not willing to help me pay for a new vehicle do I have any options?

  1. At the very least he should split the deductabile with you.

    not much to do if he wont though...

    Pluss it would probably cost ya more than the $500.00 deductable

  3. Well, this depends how far you are willing to go. You may be able to take legal action or claim off his insurance. Note, you should have checked all insurance details prior to lending the vehicle out, and that he is comprehensively covered on the policy.

  4. well there is no verval contract nor writen one ... and u was who let him borrow it so I do not think a judge will see it ... to give u a case... m sorry u shouldn't have trusted him ..... do not trust anyone ...

    I don't lend my car to no one because if something happens m held responsable because the car is on my name so do not trust no one.....................

  5. You should be able to take him to small claims court and get the money out of him. Nice step dad you have there!

  6. Not really.  Your insurance paid you the ACV.  With the exception of the deductible, you are not owed anything more.  You were made whole.  

    You can file small claims for the deductible, but don't count on prevailing.

  7. If you are thinking of sewing him you can win the 500 in small claims he took responsibility for it and owes you that go to your clerk of courts ask to see someone about free legal advise they will help you. GL TC be safe laterzzzz...
