I let someone temporarily rent my house, without a lease agreement. ?

My husband bought a mobile home before we go married and he recently died in a car accident, leaving behind our son and I. It was so hard for me tostay in our house after he died so I temporarily stayed with my parents. I let an individual stay in our house because they had no where to go. We did not sign a lease agreement, because it was only temporarily and I have asked him to move out and gave him a month. Now the individual is refusing to move out. What sould I do?

  1. Get a lawyer and have him evicted.


  2. First, I am sorry for your loss.  I cannot imagine how devastating this must be.

    As for the house, talk with your local police department.  If they are not able to do anything, then consult with a competent attorney.  You own the house and an attorney can tell you exactly what you need to do in order to reclaim what is rightly yours.

  3. yOu don't need an attorney for this, contact the police and they will do a proper eviction. Sorry for your loss and hope everything brightens up in your future  

  4. You may have to resort to contacting your local police department and telling them the story.  Then they can do the eviction.

  5. YOu go to Small Claims Court and pay $35.  You will get a court date. SHow up.  The judge will order the person to leave in a few days.  If he doesn't leave, the sheriff escorts him out.  The sheriff does not take any excuses.

    If you have a little extra money, hire an off-duty policeman to go to the house when you know the occupant is there.  Tell him to leave. /

  6. You do not need an attorney unless you want to go that route, but you do need to follow your states laws exactly as written.

    First off, you have to give him proper written notice to terminate his month to month tenancy (by default) per your state's landlord tenant laws. The amount of notice varies by state, so refer to your state's landlord tenant laws.

    If he does not vacate per the notice, you then have to file an eviction through the courts.


  7. I am very sorry for you loss.  You have to sue him in small claims court for possession.  The court system is slow, but it works.  Might take a couple of months though.  Good Luck.

    EDIT:  The police WILL NOT get involved, this is a civil matter, he is living in the mobile home, and all of his possessions are in their with him.  They will not remove him from the premises.  You have to take him to court and sue for possession.  Take my word for it, I have gone through the same thing.
