I live in Georgia. My HOA has put a lien on my home for failure to pay HOA dues!?

I was paying my dues electronically thru my bank until my HOA got bought out by another company, which changed to a new address. My payments where being sent back to the account Id designated for the HOA payment for 9 months without my knowledge. Now my HOA has placed a lien on my home! Now I have to pay overhead from this legal collection agency as well! Is there anything I can do about this?

  1. Yes, pay up before the tab gets bigger with interest or other fees.

    HOA is a Home Owners Association. They don't get bought out.  It is more likely that the management company changed.  I am sure your HOA sent you notification of the change.  It is your responsibility to make sure your payments go to the correct place.

    Secondly, how could you not notice the electronic payments being returned to your bank account.  Those transactions had to show up on your monthly statement.  It is very irresponsible of you to NOT review your bank statement, or reconcile your bank account, for 9 months.

    I also suspect that the HOA management company sent you some past due notices during the 9 months before putting that lien on your property.


  2. Not really.  Sorry.  The only thing I can think of is that if they didn't notify you of the change, you might have a case in small claims court, but I wouldn't count on it.  You might want to start balancing your checkbook so that you will be more aware of these types of issue in the future.

  3. .    Yes.  I had this happen to me.  I needed to watch the accounts more closely to see that the money was being returned.  My fine was almost as much as the debt.

  5. You did not notice they were not getting their funds for 9 months?   No letter? No call?

    You simply need to pay this off.   HOA's do this all of the time, you will not be the first in your neighborhood.   In most states they can foreclose if you do not get this taken care of.

  6. Yes there is one or two things that may help - if you can recover (or at least locate ) the money that was sent to the wrong HOA account -- and show the HOA a valid legitimate bank error they may call off the lien.

    To do that go to the bank and ask for an accounting of all your electronic payments. Ask where is this money from these transactions since the correct payee did not get them. If the bank can locate them -- get a statement from them about it. Take it to the HOA and talk to the highest person there - the HOA director if possible.
