Question:

I live in Oregon and bought a 1997 dirt bike. After i paid $900 i found out the title is wrapped up can i sue

the sale was private and i was assured there was a title, unassuming the title was wrapped up in the bank on one of his pickups. They took repossession of the dirt bike and i want to know my options? I still owe the $1100 dollars but i want my money back because i refuse to pay the rest when the bank owns the title.

  1. go and talk to the gentleman you bought it from......and bring a fn 12 guage with you


  2. your screwed, at best you can ride on trail,but you can never regiser it. Sorry, lesson learned. If you owe bank/personal loan payments on it, your extra screwed. You have to pay that back. If your paying the dude direct, F him,don't pay a pennie. And DO not give the bike back. Part it out and try to recover some of your money.

  3. IANAL, so take every thing with a grain of salt, but why did you assume that it was a clear title? If you can show that he deliberately decieved you, you can probably make a case in SMALL CLAIMS COURT.

  4. You were foolish to buy a vehicle without being able to immediately see the title to insure it was free and clear. This whole thing sounds bad because you still owe them. There is nothing to for you to sue them over. Either you pay them the remainder and hope they will provide the title or they can repo the bike from you if you don't pay.

  5. don't butt heads with a bank... you will NOT be happy at the end of it all... you will get screwed over if you try.

    now can you sue HIM? perhaps... it's kinda on the fence and would depend on laws in your local state... call a lawyer and ask them what your options are.... not all will tell you over the phone, but there are more then enough that will hear your story out and tell you all your legal options. (and no it doesn't cost)
