Question:

I live in a condo and I want the people renting below us to get kicked out. How do I do this?

Three young guys are renting the condo beneath us and stay up until 4 a.m. playing very loud music. We have tried talking to them, talking to our association, getting security involved but nothing seems to make them stop. I am at my wit's end! What can I do to force them to leave?

  1. NOTHING.  You don't own the unit, and the only person who can evict them is the owner.  You MIGHT try talking to whomever owns the unit to voice your concerns.


  2. complain about them to the person who owns the whole condo thing. if u have friends in your condo who dont particularily care for them either, ask them to complain as well.

Ask the association for a copy of the rules governing conduct in your complex.  If they are violating rules, insist that the association enforce the rules.  If they are not violating any express rules of the complex, then you can call the police and lodge a complaint.  The complaint would fall under some variation of disturbing the peace.  If the police agree that there is a violation, they may be willing to enforce it with gradually more severe penalties until the young men leave.  If the police are not willing to expend the manpower, you can file suit against the owner of the condo who is renting to the young men.  The suit would be for some kind of violation of your right to enjoy your property through negligence on the part of the owner in not containing the noise within the unit.

    Another option is to induce the young men to leave.  If your units are similar, advertise a unit for rent and show yours but tell prospective tenants it will actually be the unit below.  When you find suitable tenants, offer the young men below enough money to entice them to move out, and tell them part of the deal is to offer the new tenants to the owner of the condo as replacement tenants.

    You might have to also complain a few times to the owner of the unit below, but avoid alienating them, because you need their agreement to replace the loud tenants with the ones you find.

  5. Never mind security, call the police. There should be noise ordinances for your city or town. At some point, the police coming on regular basis is going to force someone into action.
