I live in apt. in CA. We arent able to renew lease in sept. we didn't pay rent this mo. what will happen?

We have lived at same place for about 10 years. I got married and moved out of town, but my dauhter still lives there and the new owners checked her background found a criminal record on her, now they can't renew the lease in Sept. and they decided not to pay the rent this month. Can they get locked out?

  1. I don't know about a lock out law in CA.  Since you have been there a bunch of time, they might go easy on her.  Why didn't you leave it in your name then. . .that way it could renew.  I start lockout proceeding if you are three days late.  When you don't pay, you are taking my livelihood.  That's money out of my pocket and deadbeats are thieves to me.  If you told me a sad story and had been there for 10 years, I would give you a break.  But your daughter really hasn't been there that long and now she is late on her rent.  She will not be able to stay there through August tho' I'll bet.

I think your daughter can stay in the apartment without paying for another couple of months.  cause landlord can't just throw you out & court drags its feet especially with current housing crash.  Let ur daughter enjoy her free stay for at least two more months.  kind of revenge against ur greedy landlord.

  3. They would have to be served a proper notice...a 3 day "pay or quit" notice.  To have them physically removed, the manager would have to go to court and it would take more than 30 days to evict them.  If your name is still on the lease, you will also be sued for the unpaid rent. attorney fees, and damages.  It will likely also go on your credit record.  So I really hope your name is off.  She is going to have a hard time finding a new place with an eviciton.  I'd tell her she better pay.  CA can garnish wages on judgements.
