I live in texas and we have been with out an airconditioner for 3weeks now. can we break the lease?

our landlord told us that our airconditioner would be replaced in 1 week. It has been 3weeks and the temp has been 102- 104. HOT and miserable. what can we do to get this matter taken care of. they are dragging thier feet. can we at least get them to put us up in a Hotel?

Along with everything else mentioned you need to create a paper trail so you have something to take to the court/attorney.  I suggest a certified letter to the management company or land lord thats states the initial date of contact on this issue and the time that has passed without resolution.  Since a certified letter has to be signed for the management company/ landlord cant say they were never contacted. You can do this through your local post office.

you need to look up the renters guide.  Here in Calif ibelieve you don't have to pay rent at least for that month if it hasn't been fixed in a certain amount of time.

COntact the management again and indicate to them that they were to replace the unit 2 weeks ago. Tell them that failing to replace the unit constitutes a breach of your contract to rent a fully functional and habitable apartment.

Indicate that they should offer another place or a hotel stay to make up for the inconvenience and HEALTH RISK of not having the air conditioning repaired.

State that you will seek legal action against them if needed.

Well Maxine, you seem to have a valid case and I do feel your pain as I live in Texas also; you must be in the Valley with those temps.   The first thing you should do is call a good attorney the first thing Monday morning; at least by 9:15 am.  Tell them your situation and I am pretty sure they will be able to get you headed in the right direction.   If legal action needs to be taken, the attorney can get the ball rolling as soon as possible.
