I m just married with an american, which paper should I start?

Hello everyone!

I'm a French girl, just 3days married with an American. I'm still in USA and intent to live here. I came with a J-1 visa, this one is NOT expired. I do not have the 2years required. Do I have to file the I-130 form, or I start with the I-485 and I-765, I-698,...?

Which one is the first one?

    since he's a citizen; you can file the

    I-485 ($1010.00)

    I-693 medical (free - just doctors fee .. i didn't file this with I-485, then I got the 'request for initial evidence' letter askin for my medical.

    I-864 (affidavit of support - free)

    g-325 (biographic information - free)

    I-765 (work permit -free if adjusting status by something something)

    I-131

    but don't take my word for it ... they probably done changed the law or prices or something ...

  3. George is correct, however I just wanted to add some clarification.

    One of the first things I would do is request a police certificate from every country you have lived in for more than 6 months, including France, try and get your medical history/vacccination record from your doctor in France and your birth certificate, if you do not have that with you. Then I would complete Form I-693 (just part one and do not sign it) and then schedule an appointment for your medical with a USCIS approved doctor.

    Once those two items are done, then I would start working on the forms and gathering all of the documentation you require.

    Your husband will need to file the followings Forms: I-130, G-325A and I-864.

    You need to file the following Forms: I-485, I-765, I-131, G-325A and of course the I-698.

    Once you have the medical and your police clearance forms in hand and you have completed all of the forms and then gather all of the supporting documentation that each requires, then submit the entire package at once. This will save delays and the possibility of subsequent forms and documentation going missing or getting misplaced.

  4. Well, you're the French girl in this, so your American husband is the one to file these things. You two need to file the I-130, the I-485, the I-765, the G-325a and the others together at the same time. Everything flows from the I-130 though. But you need to put it all together, so it all works together. You'll need the work permit as soon as possible, as it will be quite some time before the petition is approved, and longer still before you will actually get a green card. USCIS is backlogged in everything they do. If you submit the I-130 without the other stuff, it will be impossible for them to coordinate everything, and that's not good at all for you. By the way, don't leave the US until this is all finalized unless you apply for Advance Parole first, or you won't be able to come back until you have an immigrant visa.

  5. Get an attorney. It will save you a huge headache.
