  1. You need to be clear.  Who was married 10 years ago and where?  Was there a divorce, when, where?

If she was married 10 years ago, and you went there and got married to her, then that marriage is not valid.  There is no divorce in the Philippines.  The US will not allow her to come to the US as a fiancee and get married here.  She will need to seek an annulment through the Philippine court system.  It's a long and costly process and there is no guarantee of success.

  2. Since there is no divorce in the Philippines, I'll assume you're the one who is still in process of getting a divorce. Was your wedding just a ceremony?Because in order for a US citizen to be legally married in the Philippines you will need to get a legal capacity to marry in the US Embassy and present a divorce decree.Your marriage should also have been recorded in National Statistics Office.I'll suggest you take care first of your divorce to make yourself legally free to marry. You can either petition her as a fiancee or spouse.I suggest you can join forums in www.visajourney.com so you can meet other petitioner with the same situation.Good luck.
