I met in an accident but was not at fault. Will the person's insurance cover my costs if i'm uninsured?

  1. In the U.S. it is illegal to drive w/o insurance (I think same for Canada).  You would be in the commssion of a crime (driving w/o license) during the accident.  I don't believe you would be covered.

    Since you were driving when you should not have been, you are partially responsible for the accident.


  2. Ontario has a special type of no-fault system whereby each party is suppose to seek compensation for vehicle damage from their own insurer first. Since you do not have an insurer to seek compensation you will have to sue the other driver in court for the damages. Of course this means you will have to admit in court that you were driving without insurance, at which point the court transcript will be forwarded to the police and you will be issued a ticket for driving without insurance. For a first conviction, the minimum fine in Ontario is $5,000 and the maximum is $25,000. For each subsequent conviction, the minimum fine becomes $10,000 and the maximum becomes $50,000. In other words you just screwed yourself. So at this point you will have to pay for your damages yourself and hope the police never find out about this incident. Then go out and get properly insured so you will not have to worry about stupid stuff like this.

  3. There would have to be serious proof showing that the other diver was seriously in error. The other person's insurance company will most likely go after you since you have no backup...... your own insurance. Forget about your damages but instead think about what they are going to do you for.
