Question:

I met my soulmate 8 years ago. She lives in Australia, I live in US. How do I get her here to stay? same-s*x?

Ok so the main issue is that we are g*y. i met her online 8 yrs ago, we've known for almost 3 yrs that "she's the one" lol, but its not like we can get married. Its a federal issue, no going to Mass. or CA. I went to Australia a year ago for 3 mnths. she wants to move here with me. to further complicate...she's 54 and has a cancer gene, in remission, but inevitable. i cant afford health insurance myself, where do i begin? Aus. has socialized med. but we dont. i just dont understand how i could have met my soulmate but am not allowed to be with her because we are both women. love is love and you fall in love with whom your heart desires, its not about age, gender, race, or what country youre from. She cooks, but so does everyone, its not like its a priviliged skill letting her in this country. She is capable of working. Any information offered is greatly appreciated, This is breaking my heart. Its going on 3 yrs of research without a solution, I cant give up. There has to be a way.

  1. Well, there are possible ways. The Diversity Visa Lottery is one, but not the only one. Basically, though, under US immigration law same s*x relationships, whether sanctioned and recognized by the several states or other countries, or not, cannot form the basis for immigration status to the US. US immigration law hasn't become that progressive as of yet.

    So, your partner would have to quaify to remain in the US in some other manner on her own. The DV lottery is one that leads directly to a green card, and of course, once she has the green card, the two of you can live happily forever afterwards. Depending on her education and experience, she might qualify for an H1b visa, for skilled workers, or the special Australian version. Or maybe a student visa, and there are other types as well. Where there's a will,... but it will be harder for the two of you to work this out than it would be for heteros, unless the law changes.

  4. With the disease she has she would not be allowed to immigrate to this country.  Your only chance of being together is for you to go to Australia to be with her.  She needs the health care that they offer her.  Best of luck to you.

  5. The only way is for you to move there. Australia does recognize 'same-s*x' for immigration purposes. From the sounds of it, that would be a better option from the health care end of it too..

    The only option for her to get here would be to win a spot through diversity lottery. But, only 50,000 are awarded annually.. The diversity lottery happens again in October and you can watch this site for it to be going again..

  6. You are correct, there is no legal way for her to come to the US as there is no way for you to sponsor her to come to the US.  Her only hope would appear to be the lottery, if Australians are allowed to enter.
