I misses a court date on july 17 2008 I was assaulted on july 16 and just got out of the hospital july 19?

I was assaulted and almost choked to death what are my chances of not going to jail when i go back i still need surgery done on my neck. The court date was for sentincing for probration on a felony charge. I had signed a plea agreement

Easy answer.  Just call the court system in your area and explain what happened.  Make sure you have the paperwork from the hospital (i.e. discharge papers) when you call.  I can't see any reason why your court date could not be rescheduled.

Very easy you need to call the court house and explain the circumstance and have all your documentation and if you have an attorney they should of been there if not then time is very important so get on this asap and if you can get to the judge to your case that is even better. It all depend where u live. YOU NEED A NEW COURT DATE....and I'm praying for Divine luck on your side and sorry to hear about your assault take care.

You should notify your attorney, the  court would postpone your hearing.

Being in the hospital is the best reason for missing a court appearance. You will need documentation from the hospital or the attending Dr. stating you were in their care from  July 16-19 th as proof to the court that you were in fact hospitalized. Chances are good that a FTA warrant has now been issued for you, but with that letter most reasonable Judges will stay the charges and cancel the warrant. You may want to l et your lawyer know about this ASAP!!!
