I am going thru a divorce with my soon to be x wife, the marriage was a sham and we are both trying to move on, it is not that contested except for our 2 year old son. We are trying hard to be civil and work out a parenting plan.

At any rate, we do not own a home. We are only renting with quite a few months on the lease. She has chosen to move in with her mother to help her out and I shall reamain here. Since then I have met somebody new who I have really falling for. Yes I have given myself time to work out my issues thats not what this is about. My wife has to moved on with somebody else.I need to know how I go about getting her name off the lease, also I plan to move my new love and her 3 year old into my house in the next couple of months. Legally speaking, as long as my girlfriend has good credit and no record which is the case. How do I switch names on the lease with the landlord? It is privately owned by a person not a corporation if that helps. Thanks for your help.

  1. Just ask. As long as the landlord is getting paid on time - it shouldn't matter. Offer automatic withdrawal - from your account if extra coaxing is needed.

But I doubt you will. Landlord's just don't want to be troubled - this is no trouble. They still have a tenant - you're still paying....

On a side note - consider talking to someone (counselor) if you're not already. You sound like you're handling all of this really well but now's the time to ensure you can lay a better foundation with this girlfriend. Having personally made the same mistakes over and over again - welll I wish that on no one and give you the best.

  2. Easy...you go to the landlord and explain the situation to him/her.  The landlord is the only one who can change a lease and remove or add anyone on.  Situations like this come up all the time, yours is not unique.  It should be an easy switch...our apartment complex (over 1000 apts) does it frequently.
