I need advice on this situation!?

I fell in a restaurant Saturday and hit my knee on the cement floor very hard. I went in to the doctor yesterday due to the swelling, pain and not being able to bear weight. It was determined that I have a torn ACH tendon. I am now looking at physical therapy and rehab and possibly surgery. My husband spoke with the restaurant yesterday and they were horribly rude and uncooperative. Any advice on what to do??

  1. A lawsuit would require you to prove that the restaurant was negligent in some way.  They are not the guarantors or your safety.  If you think your injury was someone else's fault, you can hire an attorney or you can try to contact the insurer for the restaurant directly.


  2. you need to get a personal injury lawyer on your side...I'm pretty he/she will be able to advice you on what you need to do...

  3. You could contact an attorney to represent you with the restaurant ownership.  

    I'm sure they would be more willing to cooperate then!

  4. When you fell did the restaurant people see this? Was it documented? with the place? Keep your bill from the restaurant. It sates the time and date on it. Yes you could sue this place and I think that you should. And by them being rude and not supportive of what happens means this probably has happened to them before.there should be a security camera in the restaurant. that maybe your lawyer could get a hold of. Don't call  the restaurant and ask cause they will get rid of the evidence

  5. .   Not every fall is "caused" by something.  So your burden of proof is to show that your knee did not just "give out" on its own. That your fall was caused by negligence. If you can do this, you will win.

  6. Did you fall because of something the restaurant did?

    Where was the cement floor?

    Was the torn Achilles maybe torn before you fell?

    If you fell, because you fell, then the restaurant owes you absolutely nothing.

    You have to prove they were negligent in some way.  

  7. Write down the time and date, exactly what happened (before you forget).  Have the receipt of your meal.  Go back and take a picture of the area.

    Then get a lawyer.  You just want your medical covered.  Not to be greedy, just needy.  

  8. Do not hesitate.Get a lawyer now.You dont have to sue for lots of money.Just sue for damages and court costs.
