I need any information on child custody for low income individuals in Illinois?

I know there are probono lawyers but I have a brother in law who only makes a couple hundred dollars a week and they say he doesn't qualify. Any information would be great if you can. The mother is unfit and this child needs to be in the best hands. custody has not been established and no child suppport papers but he is paying her money every week and only gets to see his son when its convenient for her. she leaves the child with her sick mother all the time who can not take care of him. We need help fast. Please anyone who can help make this happen with any information please respond. They were never married.

  1. Under Illinois law, If custody has not been established, HE has every legal right to take the child, and not allow the child to be put in harms way. I might suggest that he file a motion for temporary custody.( he can do this himself, without a lawyer). If he is giving her money, without a court order, it is nothing more than a gift, and will not be considered child support. Depending on what county you are in, you might want to involve DCFS, but i wouldnt involve them except as a last resort.  You could IM me for more details. Been there done that
