i need help with immigration to america i have an america husband and i am british i was in america living with my husband but had to leave cos my father got sick with cancer and now im having troubles getting back to my husband, i have an i130 approved but they are telling me i need to start over, but then someone else at uscis said if i contacted the nvc they could send a visa to the consulate in london, but the nvc do not have my i130 on file so have told me to contact uscis again and get them to forward it to them. i am lost i have done all of this but keep hearing different things, if you know anything that could help please contact me i appreicate it my kids miss there dad

  1. You better also need to consult with Immigration Attorney. Wish you the best.


  2. The I-130 has to be transferred to the embassy or a consulate in the UK.  If you cannot locate the application I would suggest you or your husband contact the Congressman who represents him.  It's far better to contact the Congressman's local office than the office in DC.

    Have a case worker, using the receipt number and your address in the UK, get in touch with somebody at USCIS who can track the I-130 down and mark it for processing in the UK.

  3. Go to the CIS website. Download Form I-824. This form should be filed with the USCIS office that approved the original application or petition.

    Use the form to request the approval notice be sent to the U.S. Consulate where you want to get your visa.

  4. Immigration does have an office at the US embassy in London. I'd start by talking to them. They could request a transfer of the petition from your local USCIS office to Embassy London or at the very least to the NVC. If they don't seem willing to help, then have your husband contact his congressman or senator for additional assistance.    

  5. If you're in the US, schedule an InfoPass appointment at your local USCIS office:

    If you're outside of the US, go pay a visit to the US embassy, or at least call someone there.

    I suspect the InfoPass appointment will be a better use of your time, though.
