I need help with law and hierarchical relationships.

This is the question:

Discuss the hierarchical relationship between the various kinds of law, such as constitution , statutes and regulations. Debate the reasons justifying the hierarchy.

I have come up with that the Constitution is the highest law and the courts must be consistent with it. Statues may establish rules that govern certain kinds of activities. I need some help debating the reasons justifying the hierarchy, and the examples to support the argument.

  1. you need more levels than that in your hierarchy.  try thinking about the broadness of applicability for your justification.  think about the changeability and how easy the things are to change inyour justification.  look at the durability, look at

    also think about whether moral law (god's law or whatever - absolute justice as an ideal) is actually above the constitution...ie const tries to implement it.  


  2. The constitution is known as the supreme law of the land. No law or statute can contradict the constitution.

    The constitution ensures the rights of all individuals and protects from oppression and inequality. That is why it is so important. Because we live in a democracy, majority rules, but not everything could be put to a vote if it would be unconstituional. Otherwise we would live in a mob-ruled state and that isn't always good. For example, if someone put something on the ballot that said only blue-eyed people have to pay taxes, then the majority brown-eyed population would prevail and that would oppress blue-eyed people unfairly.  I hope that made sense.
