My husband filed for his visa he came as an illegal immigrant. We known for awhile that the petition has been approved, but now he is just waiting for his appt. letter to go to Juarez, Mexico. Is there anything we should know that they wont tell us before we go?

  1. Yes, he will be rejected and banned from returning to the United States for 10 years.  This is due to him being an illegal immigrant, living illegally in the United States, for more than a year.

At that point you will have to file an I-601 (Application for Waiver of Ground of Inadmissibility) to appeal the rejection and ban.  If he had no problems with the law while in the United States, other than being an illegal alien, and he's married to you and if he has kids (you didn't mention if you have kids) there's a very good chance the appeal will be successful.

I recommend you find a good, board certified immigration attorney to handle the I-601 appeal for you.  You can expect it to take up to a year while the appeal is working its way through the system.  He will need to stay in Mexico during this time.
