I need some good advice. Can anyone help?

Ok here goes. A couple of months ago I had a few checks to bounce, and right after that my mom passed away and I forgot about the checks and didnt go get them. I got a phone call today and said that the District Attorney had them and had turned them over to the sherriff for them to arrest me. Does anyone have any advice on how to take care of this. I dont want to go to jail, but I dont have all the money to pay it off, This is in the state of Alabama. Someone please help, I cant even rest!! Please.

  1. You may be able to convince the court that this is a civil matter - they can offer you some deal like paying it back over time.  If you have no record and the money isn't much, jail is not very likely.

    Aa for the money itself, the creditors may decide to simply execute a civil jdugement - they garnish or attach your finances until yuou can afford topay them back - there will probably be interest.


  2. First, you can't go to jail for a debt. Debtor's jail has long been demolished... I think pre- Revolutionish era.... Anyway, So you are not telling the whole truth, either you are falsifing the checks which would be the reason why you have a warrent. Now the other people who would be involved are the bank and the payee....

    The Bank if they paid the checks is the one that you owe the money to, they will close you account, or aquire your money as it comes in. If you don't have it paid within a certain time they, I believe, will close your account, but definatly put you on chck systems, which basicially is a system that all the banks use in order for them to get all the money back that you owe them.... for instance, you would have to pay like 50/wk to pay off your debt to the bank.

    The payee, depending on who it was will most likely call you and try to get you to pay your debt.... a creditor will start with the phone calls, and you should be able to work out an arrangement for that.

    If it is something that can be repossessed then you might lose it, i.e. car and whatnot, that is something in a totally different nature that you will want to ask in another question... i.e. "how to keep your car from the repo man?"

    The "Attorney General" has two of my debts that I owe to two different colleges. It is actually a creditor that has bought my debt from the "Attorney General" and is trying to make their money. Listen to the small details, they will work for the Attroney General and are trying to collect a debt.

    Worse case senerio, a civil judgement... watch the newspapers to be served, and show up on your courtdate. Now if you falsified checks in anyway you are in a lot more trouble.... were talking huge.  

  3. Don't answer any questions!!!!!!!!!! If you get arrested, say that you want an attorney after they read you your rights. I repeat, DO NOT MAKE A STATEMENT TO THE POLICE! Good luck.

  4. As sad as it may seem to you, you only have one option, find the money and pay of the creditors. The businesses that took your checks are not going to concern themselves with your personal life.
