I need to find out if my child who is cree first nation has any rights protecting him fr childrens aid society

I am looking for any help or imformation,because my son has been taken by c.a.s and I feel that they are stealing my child,he has his indian status and i need to know if they can do this

  1. Contact his tribe. They need to know what is going on. I do know that they have to place the child in an indian home so that he can continue to learn about his heredity

If the State feels you have failed to maintain "minimum parenting standards", the State has the responsibility to remove the child if the child is at risk.  The case is then adjudicated in Juvenile Court to ascertain whether the child is at risk of abuse or neglect.  It is not "stealing" because as soon as a child is taken into Protective Custody, the Court becomes involved for the child's protection!  The State must immediately begin the services to assist the parent[s] to correct the issues in the home that necessitated the removal of the child and to work towards reunification with the family.  All children - needless of their ethnic background - deserve to be raised in a safe and nurturing home.

    However, the caseworker/investigator, the State's Attorney, GAL, CASA volunteer [if there is one] and the Court must be informed that the child is Cree so that they [State's Attorney's responsibility] can report the removal of the child from the mother's home to the Cree Tribal Counsel.

    The Tribal Counsel should work with the protective services and insure that your son is placed in culturally sensitive placement and/or come and pick up the child themselves.  That is the tribe's decision.  

    The most important issue continues to focus on the safety of the child and your alleged inability to provide a safe home for the child.

    Please work with the caseworker/supervisor to correct the issues leading to the removal of your child!  THAT is what would be best for your son!
