Question:

I need to get my I-131 re-entry permit?

I just found out that I need a re-entry permit because I'm gonna be gone for more than a year. I just filed it last week and I have to be gone by August 14. Is there any way I can make the process fast enough that I'll at least get my biometric appointment before I leave? I called the uscis info and the lady told me there is no way but I'm hoping someone knows a way around it because there is no way I can reschedule my flight.

  1. The application for a reentry permit is form I-131. The Reentry Permit is actually form I-327, but the important thing is that you file the I-131 right away, before you leave.

If you want to get a re-entry permit, file Form I-131, Application for Travel Document. You should file this application well in advance of your planned trip. The I-131 is available at uscis.gov.

The instructions on the form will give you more details. If you have questions after you read the instructions, just check our website or call customer service at 1-800-375-5283.

Departure from the United States before a decision is made on an application for a Re-entry Permit usually does not affect the application. However, where biometric collection is required and the applicant departs the United States before the biometrics are collected, the application may be denied.

Apply now to cover yourself. If it turns out that you cannot be in the U.S. for the collection of the biometric data, that's something you can work out later, but if you don't file before you leave, you'll have no argument at all that you qualify for the permit.

  2. It is possible, though not guaranteed, that you can get your biometrics done at a foreign consulate.  View this information from the USCIS and see if any of this applies to you.  http://www.uscis.gov/portal/site/uscis/m...

Still, it doesn't seem hopeful; you really should stay till your appointment.  You say that you cannot reschedule your flight, but you don't give a specific reason why you cannot.  You'll need to weigh your options.  What bad things will happen if you miss your flight?  How terrible would it be for you to not be able to come back to the US?  I know it's a rock and a hard place for you, but you may be forced to pick one.  Another option is for you to come back earlier so you're not gone for over a year, or for you to go and then come back for your biometrics appointment.

I know this is a rock and a hard place for you and that these rules changed very recently (a couple months ago) so it was very difficult for you to know what you needed to do.  Please accept my best wishes for you as you make this difficult decision!
