  1. 1.  US citizen or resident alien.  If filing jointly, both spouses must qualify.  Aliens must have a valid SSN, not an ITIN.  (There is a new exception for military personnel married to NRAs with ITINs.  How this will be verified and handled, no one knows.)

    2.  File a 1040/1040A or 1040EZ return.  The IRS will use the tax return as originally filed.  Errors can cause the rebate to be withheld.

    3.  Either pay income taxes *or* have at least $3000 in qualifying income.

    4.  Income can not be so high as to cause a phaseout.

$3000 of qualifying income is income from a W-2, self-employment income (needs to be more than $3300 since it's after the 1/2 SE tax deduction), Social Security Retirement or Disability benefits (but NOT SSI), certain VA benefits or combat zone pay.

  2. At least $3000 total from wages, net self employment income, social security disability or retirement, railroad retirement, or some VA benefits.  There are additional requirements also, but if you don't have the required $3000 of qualifying income, then you aren't eligible unless you paid some federal income tax.

  3. In addition to all that other info, you can't be claimed as a dependent on someone else's tax return to qualify.  Otherwise, you should be fine if you meet all the technical and income requirements.

Remember,  file quickly if you haven't already; October 15 is the deadline to do so electronically & if you can't file by way of the wire you should download the appropriate forms and file a paper return ASAP. :-)
