I need to know adoption process on oregon regarding pre adoption process does court needs need to be involved?

this involved domestic pre adoption of infant... birth parents involved open adoption. please help

  1. I live in Oregon as well and I am guessing that as long as the birth mother is willing to sign over her parental rights and let you adopt the baby, then all you need is a lawyer. My husband adopted my baby and and all we did was hire a lawyer,the lawyer did all the work, we signed the papers, the birth father signed his part of the papers, we went to court one time and it was done.

    Now if its gonna be an open adoption, then you can have your lawyer put in the paper work that the birth parents can have pictures once a year, or one visit per year, or how ever you and the birth parents agree. Bottom line is once you have your lawyer do his part and everyone signs the paper work. You will go to court one time and its over. As long as everyone agrees on the terms of the adoption.

Adoption is a legal proceeding and does need to have a court involved at some point.  Pre-Adoption paperwork and background checks will need to be completed.  Since the birthparents are involved and are interested in having an open adoption, I would suggest contacting an attorney to process the paperwork for you.  An adoption agency can also process what is called an "identified adoption" for you also.  

    Either way, you will need to have a home study done, as well as background checks and fingerprints, etc.  Your state may have its own requirements and you will need to check with someone who can insure that the paperwork is done properly, otherwise you risk the courts not allowing the finalization to occur.

  3. courts and lawyers will definitely need to be involved. Most adoptions, every private open ones, require an adoption homestudy by the state. It's a process that won't happen over night.  First get an adoption lawyer.
