Question:

I need to know if the car accident i was involved in was my fault??

I was driving on a snowy freeway doing about 35-40mph. The lane i was in wasnt plowed very well so i ended up swerving and doing a 360 and ended up facing the oncoming traffic. But i didnt hit anything or any cars, there were no cars infront or behind me. So i turn my blinkers on and im about to make a U-turn, i waited for about a minute until the rest of traffic passed and be on my way when all of a sudden another car comes speeding into the lane i was in and smashes my truck in the front, then another cars hits him and pushes me even more. So im trying to see whos fault it is....obviously he came straight into me and either wasnt paying attention or lost control of his vehicle. Whos fault is it?!? State Trooper says it might be both our fault cause we lost control, but the thing is i didnt cause him to run into me, he shouldve seen me....what do u guys think???...

  2. You would be both at fault and this will be a 50/50 claim, you pay for yours and the other driver will pay for theirs.

  4. Tough one! I would say it might be both of your faults since you were in the oncoming lane but it was due to weather and you werent going too fast. It is partly his fault because he ran into you either because he wasnt paying attention, didn't see your car because of low visibility, or lost control. Gosh, I don't know!

  6. It's the snow's fault. I mean it seems like in these situations there is no fault, just unfortunate slippery surface.

    It's possible you were going too fast for the conditions, but who knows?

  7. Technically you were in the oncoming lane, so most likely a court will find you at fault, even though it's one of those cases where both drivers are partially at fault, he obviously also was driving to fast for the conditions.

  8. This can be a sticky case because you lost control of your car and ended up facing the traffic (the wrong way). The other guy was negligent for speeding and obviously not being in full control of his car and causing a major traffic accident. You may still end up winning this but, I recommend consulting an attorney first. Good luck.

  9. I think you should drive at a speed appropriate to the road and traffic conditions and you wouldn't have to ask this question.....consider it a lesson learnt!!
