I need to stay in Canada (Immigration)?

I have been on a tourist visa in Canada for almost 6 months, I'm not sure how long the tourist visa lasts? Anyway the thing is, I have a baby due here in October so I want to hang around obviously for the birth. What is the best way to achieve this?

If I applied for residency can I do it from within the country?

Or if I overstayed my visa would it be recorded somewhere and I would get into trouble with immigration? I lost my passprt over here and have applied for a new one so it wouldn't be stamped on my passport the date I entered...

Any help/advice would be great!

  1. Apply for an extension before your tourist visa runs out.  You will then have implied status until you get an answer from immigration which will probably take 2-3 months and voila, baby's born

    Other option, marry the girl and have her sponsor you.  If you apply inland, you will not be deported while your application is being processed but because your status would by unclear, you would not be able to leave or you might not be let in again.


  2. A visit visa to Canada is only good for 180 days.  So, it is about to expire.  You can apply for an extension due to your circumstances but it is not guaranteed you will get it.  You should also do this 30 days before your current visa expires.  You should do this ASAP.

    If you apply for residency you will need a sponsor.  Are you married to a Canadian citizen?  A spouse can sponsor you if they meet the requirements.  If you are not married to a Canadian then the only other way to apply is through an employer.  If you qualify for a skilled worker visa then your Canadian employer will help you file your application.  Unless you have other family members in Canada this would be the only way to stay permanently.

    Yes, you can file for residency from within Canada.

    Yes, Canada will still know if you overstay.  Your visit visa has an expiry date on it and you are to hand it in when you leave.  If you overstay it will complicate any future returns to Canada and may prohibit you from being eligible to return.  It will also cause problems if you plan to file an application for residency in the future.  Canada will know that you overstayed and may deny your application on those grounds.  It is a really big gamble to take, especially if you want to be able to visit your child in the future.

    Go home now before you become illegal and keep your d**k in your pants next time you decide to visit a foreign country :)

    The less condescending answer:

    Be a man, marry your baby mamma, leave right after that before you overstay your visa, and have your spouse sponsor you to come back. That is of course assuming that she is a citizen...otherwise you are screwed for the time being unless you have some skills and money that qualify you for employment-based immigration.
