I have a friend who is 20 and went to VA Beach a month ago. He got arrested for underage possession of alcohol and resisting arrest. He spent three days in jail. His court date is next month and they are saying he could get up to a year in jail. Is this normal or just the absolute max? Will he get jail time?

  1. If you are living in America, all i can tell you is that it is become frequent for that sort of punishment. However, it is not normal. Does he have a lawyer, if he does not, i would urge him to get one.

  2. if its a first time offense h**l get plenty of fines to pay, community service for resisting, and most likely 6mths to a year probation for the possession. if hes been in trouble before you can guarantee he will get some jail time.

tell your friend dont fight the police drunk it can only turn out badly.

ive been through the same thing so see if your state allows a first offender to plead non-adjudication. that means after the fines , probation, and possibly community service have been completed, the charge will be completely erased from his record.

  3. Language question?

  4. Depends.  If it is a first offense, I doubt he'll get jail time, probably probation and fines.  But I am not a judge or a lawyer, so it's only my best guess.  Really dumb thing to do, though.

  5. was he driving? if so it will be bad. but if he was not driving or giving it people then he should not get too bad. maybe the worse he will get is the weekend in jail. at the worse. he should get a good lawyer and just get probation.

  6. that seems a little extreme...

    unless he assaulted an officer...
