  1. Usually, the bylaws allow them to foreclose on your property.


  2. An association can foreclose just like a mortgage company.

  3. They can, and often do, foreclose on your property.

  4. Why would you rip off your neighbors like that?

    They are generally very aggressive, more aggressive then any bank, about exercising their right to foreclose on your property.

  5. You owe the money.  They take you to court. The court agrees that you owe the money.  It gives the HOA a judgement.  If you still don't pay, the HOA can go back to court to "execute" the judgement.  If granted, the sheriff allows you to keep 1 bed, 1 table, 1 tv.  Everything else can be sold until the judgement is paid in full.

  6. all of these answers have good information.  it depends on the association, but this is not something I would tempt.  They can, and most likely will place a lien against you and this will prohibit you from selling or refinancing until the lien is cleared up, read your bylaws and then take appropriate action

  7. The HOA can foreclose. However, it is unlikely they will kick you out of the townhouse.  They will more than likely just lien the property which they have to do before they proceed with a foreclosure.  In order for them to foreclose they would have to be in first lien position.  So unless you own the townhouse free and clear they can't kick you out or sell your posessions.  They would have buy out the lienholders above them.  If you are having a financial difficulties and are having trouble paying your mortgage, you may want to consider a loan modification.

  8. Read the bylaws of the association.  If it's a legal debt, they will be able to place a lien on the property at a minimum.
