I own my house. i want a divorce. my husband has no job can he make me sell the house if its in my name alone?

i bought my house after we got married. im not happy with him and wanna no if he can make me sell the house if i divorce him.

  1. No. Not if you bought the house before you were married. If yall bought the house after you got married and only put it in your name due to him having bad credit or something like that then maybe. It depends on how good your lawyer is.

    If Credit is the case, the Judge will rule depending on credibility on ontime bill payments. And if you have kids whoever gets the kids also.

  3. yes actually. Even though its only in your name, you are married making it a joint asset even more so since you bought it after you were married. You can fight for it and probably win though since it is only in your name and he has no job to pay for it. Its very likely you can keep it.

  10. You need to check the laws of the state where you live.  If you bought real estate after your marriage, many states consider that a joint marital asset even if only one spouse's name is on the mortgage and the deed.  In a divorce, he would be entitled to half.

    In some states, even property purchased BEFORE a marriage takes place can legally be joint marital property.  We bought a house once that had been bought by a single man and was in his name only.  He married about 3 years after buying it, and then we bought it 3 or 4 years after that.  When we got to closing, we ran into a snag - his WIFE hadn't signed any of the closing paperwork.  They assumed that since the house had been his alone since before the marriage, her signature wasn't needed, so she was already gone to the other city they were moving to.  We couldn't close until someone in that city found her and got signatures.  

    So can your husband force you to sell the house?  Maybe.  If your state laws say he is entitled to half of the house, you can purchase his half from him if you have the cash on hand.  If you can't buy his half, the courts can force you to sell the house and split the proceeds from the sale.  Your divorce attorney should know the answer for your state and will also know a real estate attorney to guide you through any buy-out or sale.

It depends on the laws of the state you live in.  My brother is getting a divorce.  The house was bought after they got married and he paid for the entire mortgage.  She can't get anything from him.  If she wants the get the house she has to pay him half of the value.  Otherwise the judge told them that he doesn't have to leave the house or give her anything.

    Here is what it sounds like: I won my own house, my wife doesn't have a job, can she make me sell the house if it is my name only?

    Now, most people will recognize the fact that the house was bought after the wedding and therefore the wife automatically gets half of the equity. In this day and age why should it be different when the show is on the other foot?

    my friend was married for 9 months and lived with her then husband in his home, after the divorce, she did not get anything really.
