I plan to move to canada from the US and live with my Canadian Fiance.?

We do not plan to marry for a year. I would like to be able to work while I am there. What do I need to do?

  1. If you are not going to get married then it is best for you to stay out of Canada and file as conjugal partners.  The only other way is for you to file as common law partners but that requires that you live together for 12 months before you file.

    Without marriage, that is the only way you can be sponsored into the country by your partner.

    Another alternative would be for you to apply for a skilled worker permit.  This would not require your partner to sponsor you because an employer would be your sponsor.  Of course you must be a qualified worker for this type of visa and it depends on your education, set of skills, language proficency, and time on the job.

    You need to take a look at the CIC website.  www.cic.gc.ca  Here is all the information you need about the classes of immigration and how to qualify and apply.  There is also a test on there to help you determine if you would score enough points to get a work visa.

    My name is Gabriel. I work for a private immigration firm in Toronto. Let me try and help you out.

    If you want to come to Canada, your fiance will have to file for a sponsorship application. There are three categrories of sponsorship application when it comes to persons in a relationship: 1) Spouse 2) Common-Law partner 3) Conjugal.

    There is no "fiance" sponsorship.

    I would avoid #3 as much as possible. As for #2, it can only be done if you have lived together for a year, which I do not know if that is the case. Therefore, based on the information you have given me, it is best for you two to get married and file the spousal sponsorship.

    The most important thing to show is that your relationship is genuine and not one that is used just for the purpose of moving to Canada. As you put your application together, just ask yourself: Am I showing enough to prove that my relationship is genuine? For example, the sponsorships we put together here ends up being about half a foot high when you include everything.

    There will be lots of forms to fill out and documents to be gathered. I would recommend that you seek professional counsel with this application. At least have someone review your application. Ask your Canadian fiance to look for a good and reputable immigration consulting firm or lawyer.
