Question:

I really need some information on stepparent adoption,my daughter who is 7 hasnt seen her bio dad since 6wks?

old he has made no atempt to contact me or her isnt even on birth certificate,what info i need to know is what will happen if her stepdad which has raised her since 1 year old goes for adoption of her will we have to get her bio dad to agree and if thats the case how do we do it we have no idea where in australia he lives.thank you hope you can help

  1. you need to find an attorney that specializes in adoption.  even though his name may not be on the birth certificate later on if he can prove he's biologically the father of her he legally can ask for his rights.  the best thing i would think would be to speak to an attorney first and locate the biological father and hopefully he'll relinquish parental rights.


  2. The only way you'll know for sure is to go to an attorney that specializes in adoptions.  They'll know all the laws pertinent to adoptions and can best advise you.  

    I personally think that if his name is not on her birth certificate he has no legal rights unless he wants to go to court and submit a DNA sample to prove he's her biological father and even if he does he obviously abandoned her and you and the court would look harshly upon that.  Doesn't sound like he'd ever go through the effort anyhow since he's had no contact with her since she was 6 wks old.

  3. you need an attorney, but if he hasn't had any contact, i BELIEVE, not sure, that he has abandoned the child and after so many years you can file something to that effect.

    most importantly, you need an attorney who deals in family law in particular. interview a few and go with the one who doesn't sound over the top. i had to get an attorney for a divorce / custody issue and spoke to many attorney's. they are like salesmen. they will say anything to get your business. remember, they are working for you. but before doing that, i would read everything possible about your situation and then go attorney shopping. you need to know as much about the law as they do. they just have the "know how" to make everything happen.

  5. If there is no father listed on the birthcertificate, you have a leg up on the bio father. Contact a lawyer for clearer and more legal information.
