I recently went part-time with my employer and want to roll over my 401k. My plan rep said no. Is this legal

Can I ask for a distribution and then roll it over anyhow?

  1. Yes it leagal as long as you are still working for the company.  They may not let you take a distribution either.  Why go through the trouble to roll it over anyway?


  2. You said you went part-time and then said they put you in part-time status.  Which is it?  If you don't work there anymore then send them a letter of resignation.   After that send them your distribution paperwork.  That should do it.  As long as you're listed as still being employed then they don't  have to process the distribution.  

  3. As long as you are working for the same employer you can not ask for a roll over.  Only upon termination of employment.
