I resigned from my job, and they have not yet paid me for 2 months work. ?

Are they still required to pay me after I sent in my letter of resignation? Or did I resign too soon...before getting paid.

  1. They are required to pay you for the actual time worked.  Are you saying that in the whole 2 months you never got a paycheck?  Is the company bankrupt or something?

They have to pay you for the time you worked.  So are you telling us that you hadn't been paid for 2 months BEFORE you quit?  If that's the case, then you're probably dealing with a company that's about to go bankrupt.  Call your state department of labor and ask how to file a wage and hour complaint against a former employer.  Then talk to an attorney who specializes in employment law, and find out if there are other steps you can take to get paid.  If the company is in bankruptcy you'll be listed as one of their unsecured creditors, but you won't get paid anything at all until all their other creditors have been dealt with.  If the company isn't in bankruptcy, you need the employment attorney and the labor department on your side to figure out what you should have been paid for.

  3. did you mail in your resignation and then not continue to work for 2 weeks?  You should have spoken to someone in the HR or payroll department to make sure everyone is on the same page.
