I share a car with my brother who has a full lic. I have a 1st prov. will my bro get points if i am stopped?

My bro has a full lic for past six months. I have a 1st prov. If i am stopped unaccompanied will my bro be penalised on his license. The car is in his name.

  2. yes because you don't have a qualified driver in with you,i think its 3 yrs now,they have had to been passed there test,i could be wrong,also the l plates on the vehicle,as well as no insurance,both of yous will be in trouble and the car could be compounded.

  3. you cannot drive on a provisional unless someone in the car has a held a full license for at least 3 years and is over 21 years old. You must also have insurance which is valid for you to drive on. You cannot drive by yourself

    However if you have all this and you get stopped your brother wont get any points on his license but you could be banned from driving for several years. It wont affect your brother it will just make it much harder for you to drive ever.

  4. yes course he will the car is in his name and you should not be driving it on your own if you havent passed your test,i hope im not ur neighbour i would have shopped you to the police, what will happen if ur out on your own and you have an accident and kill or injuire somebody.Its his car and he and you will be caught,remember the saying what comes around goes around.wheres the police when you want them ?If i was u wait till u pass your test and get ur own car!

  6. If you get stopped the car will be seized and you will receive points on your licence and a fine.

    If you are uninsured then your brother may be prosecuted for allowing you to drive his vehicle without insurance (which he would receive points and a fine for). If he says he didn't allow you to use the car then he would be okay, but you would then be arrested for TWOC (Taken Without Owner's Consent).

  7. If the care is shared ownership, then presumably you will be driving with or without his permission - if 'with' then he will share the responsibility, if not then you may have an added problem if you are caught.

  8. If you are stopped, it will have no bearing on your brother.

    Assuming you are insured, you will be comitting the offence of 'Driving otherwise than in accordance of the terms of your license'. I would expect a ban, as you only need six points to lose your provisional license, you only get the 12 point entitlement two years after you've passed your test. The offence carries 3-6 points.

  9. No, you just get points on your licence....who has the insurance...if its in his name, then he could get done for allowing you to use it without insurance.

  12. to accompany a learner driver you must have held a full UK licence for 3 years

    it is against the law to drive a car with a provisional licence unaccompanied and will get you a ban of at least 6 months

    the police can impound the car and crush it

    if the car is registered in your brothers name and he allows you to drive it unaccompanied then he will also get prosecuted  and points on his licence will be the least he will get

    if you drive without an accompanying driver and injure or kill someone the you could get 5 years

  13. You would incur the points if stopped and your brother would be in trouble for allowing you to drive his car knowing you dont have a full licence and insurance.

  15. If your brother is in the car supervising you you both will get points as he is not yet classed as competent to supervise. If he is not in the car and you are stopped solo he will get points for allowing it. If you are with a suitable qualified passenger you brother is ok but you and the passenger get points for any offence.

  16. Why on earth would you drive unaccompanied if you are a learner driver?  Have you been afflicted by a bout of stupidity?  You obviously don't need the car as the car will be crushed - bet your brother will be impressed!
