I signed a lease with someone, and they backed out (couldnt afford it) am I still obligated to pay?

my roomate couldnt afford to live in the apartment. Can I get sued if I dont pay my half? we signed the same lease.

  1. You are obligated to pay the entire rent every month for the remainder of the lease.  I would get to the leasing office ASAP and ask about subleasing restrictions/requirements and get a new roomie (preferably one that is more responsible) as soon as you can.  Let them know the situation and ask them to explain your options.  They know the lease terms the best, but they want all their money and if they don't get it - you will be the one that suffers.  (It will be hard to rent from someone else with that on your renting history.)  Best of luck!


  2. Yes, you still have to pay it. Actually, you have to pay it in full if you still want to live there.

    Then you have the ability to sue your friend for their half that they would owe you.

    You guys both signed, you will have to make their payments as well.

  3. You'll both get sued, the roommate is responsible too. They don't care who the money comes from, there are no halves. If the agreement is broken, everyone on the lease will get a notice.

  4. Your best bet is to break the lease and pay the lease breakage amount. Else your credit is going to get screwed because of this.  

  5. You can get sued if you don’t pay the whole rent each month. When you sign a lease, even with someone else, you’re saying that you agree to pay the full rent each month, not just half.

  7. Yes, you can get sued, but then you can also sue the person who backed out. They needed to find a replacement to take over their payments. Keep records of every bill that they did not pay. By being prepared when you go to small claims court, you will be the one who prevails.

  8. you are still liable for all the rent, but you could in turn sue th eex roommate because their name is on the lease so they are still legally liable for the rent - talk to landlord about being able to get a replacement roommate on the lease and do not give the old roommate her security deposit back - get new roommate to pay you that half of the security and use it to help pay your rent
