I sold a car and now the guy wants his money back i dont have it what should i do?

YESTERDAY BEING TUESDAY I SOLD A 1991 JEEP WRANGLER THE KID CAME BY MONDAY AND CHECKED IT OUT I TOLD HIM ALL THE LITTLE KNICK KNACKS THAT IT NEEDED PRETTY MUCH A FIXER UPPER..

THE DASH SAID IT HAS 155,000 ON THE DASH SO I ADVERTISED IT ON CRAIGSLIST THAT WAY.. WHEN I PURCHASED IT THE TITLE SAID 200010 THE LAST OWNER DIDNT KNOW ENGLISH AND WROTE IT WRONG..

SO THE KID CHECKS IT OUT MONDAY NEGOTIATES ME DOWN TO WHERE HE ACTUALLY BUYS IT FOR FREE...

BEFORE HE PAYS ME I SHOW HIM THE TITLE ... AND HE COMPARES THE VIN# TO CHECK THAT IT BELONGS TO THE JEEP AND I NOTED THE DISCREPENCY OF THE TITLE ODOMETER READING TO WHOM HE DIDNT CARE

NOW I GET A CALL AFTER HE DROVE IT HOME 65+ MILES FROM HIS DAD STATING THAT I MISREPRESENTED THE JEEP AND THAT HE IS TAKING ME TO SMALL CLAIMS COURT.. I DIDNT DEAL WITH THE DAD .. ONLY WITH HIS 18 YEAR OLD SON WHO IS OF LEGAL AGE AND HAS A VALID LICENSE I WROTE A RECEIPT STATING HE IS BUYING AS- IS .. FATHER WANTS TO SUE ME FOR THE TITLE ODOMETER DISC.

  1. If he got it for free then he shouldn't get his money back, right?

    Regardless, it says on the receipt as is, and that's that.  He knew of the discrepancy before he took possession of the vehicle.

  3. a chick brought mums car and a week later asked for her money back becoz she put to much oil in the car and blew it up u dont have to give the kid **** he knew what he was gettin sounds likea stuck up kid who got a car and then thought about  the money  dont worry he wont win he is 18 and if he didint like it he should have braught his dad to look at it with him  he has no proof he only has what u told or showd him on the car so he cant get u for anything good luck and dont worry chances are he willgive up in a week or to and for get about it when he goes and buys a nother car . the chick that got mums her mum rung us up and said dont worry about our daughter she does that to people buys a car then breaks it n trys to get her money back all the time so yeah dont worry to much besides he is just a kid still really he probly toook it out and drove it likea fool and thats why he dont like it

  4. You need to find the last owner and get a statement from him if at all possible. That sounds very suspicious to me, as though you wound back the numbers illegally, which is possible with some cars. I assume that is what they think happened which is a perfectly reasonable assumption.

    Though it is not a case of misrepresentation at all if you showed him the difference in the odometer reading. You are all clear just from doing that.

    In conclusion- find the previous owner if possible and get legal advice.

    Out of curiosity how much did he buy it for?

  7. Everything is going to be fine.  The father can take you to court all he wants but he will not win.  You and the 18 year old had a mutual agreement that they were buying the vehicle like you said ,AS IS.  

    Now I can understand their point of view as well but still.  Basicaly put, **** happens, you told them everything they needed to know.  You did nothing wrong.

  8. Misrepresentation is the giving of false information by one party to the other before the contract is made, which induces them to make the contract. If you make a contract in reliance on a misrepresentation and suffer loss as a result, you can cancel the contract or claim damages.

    Seeing you mentioned to him the discrepancy of the odometer reading and he was not bothered by it, you did  not give false information.

    Here is an example from the law handbook -  if the seller told you that the vehicle had only done 20 000 km but the odometer showed twice that, the court will probably not accept that you placed any reliance on what was said.

  9. Sounds like you did the right thing.  Was there a witness?

    You can, I believe, counter sue - if you get in quick enough depending where you are - you can actually put a court document through after you have received a formal request for payment from them for a relief from payment.  that means you do not want to pay a bill you have received.

    Dad and the kid needs proof that you misrepresented the jeep.

    Call one of the legal advice hotlines or community advice centres for assistance.

    I would still try and get him to give you a formal written request for a refund - BEFORE they lodge in court, you can get in ahead of them and beat the pricks at their own game.

Unfortunately, tis America...one can sue anyone for anything.  Many like myself hate those who cause the frivolous lawsuits.  "As Is" doesn't mean all that much, the situation w/the Vin/mileage is a different story.  I think the issue is altogether different, forgive me.  A young man of legal age felt saavy enough to venture out on his own and make a transaction in the big world; he is the one who should suffer the consequence and learn a hard lesson in life.  Assuming that everything was on the up and up, and I have no reason to believe that it wasn't.  The father is an enabler, makes me wonder how many other times he's come in to rescue his little boy.  He should read this and understand that it would be a cheap lesson for the boy to learn about life.  Someday the father will not be there and this kid won't have the life-skills to deal with a loss or a bad renegotiation or even buyers remorse.  This youngster has to grow up, and sadly the father is impeding this process.  That has always been a thorn in my side.  This is part of the reason our children will be in trouble as our country welcomes more people from other lands who KNOW how to deal with 'things'.  They, deservedly  will eat our children up and spit them out in the business world.  A pretty sad epitaph for some children; eh dad.?!  Think about it.
