I sold my brother a 2006 Polaris outlaw quad 500 for 2000$ and he won't pay me.?

I hold the title and we had a deal for 1000 down and 1000 next week and when hes paid off he gets the title. The quad was in grad shape just had a tune up and everything. Well he said is broke and Its a **** box. He wants the money back and I don't have it. He said its going to be 1500 to fix and hes not paying me the rest of the money. What is my legal right ? It was sold as is and it was in great shape.

  1. i know that they say family is family, but do what you have to do...sue him in small claims.-you will win!

    you just can't buy something, use it, then realize that it needs more work than anticipated and then want to return it...you are not WALMART!! this is not customer satisfaction here. he bought it as is and that is it, he has to pay you back whether he likes it or not.


  2. tell your parents, have them whip the money out of him. or just take the quad back and don't pay him the money back. depends on who's tougher i guess.

  3. you have the title, you still own the bike, and he will be responcible for paying all repairs needed, or  else you can bring him to court and have his pay attached and money sent to you thru courts.

It's sad to see this happen in a family if you can't negotiate with him and your parents can't help then maybe you will need to decide if it's worth just forgetting the deal see if your brother will give you back your Quad as is and no more exchange of money (cut your losses) and still be able to have a positive relationship with your brother, or make an application through the small claims court and open your family up to all sorts of negative c**p!

    I once had a situation with my brother were I brought his motorcycle from him it was stolen a day before I paid for it. I offered to pay his insurance costs and the cost of the amount owing for finance or to pay him the replacement value he took the replacement value and about 6 months later he wanted me to pay the finance as well.

    I believed paying him for the replacement value of his bike was enough and left it at that , then about 12 years later one of his friends offered to give me back his bike in parts!!!!! I had been set up but what can you do? someone has to be nice and give in to keep the peace! In the end I believe I had better value by being honest and just walking away from the problem besides I felt better knowing I did my best to be honest and positive

  6. You made a verbal agreement with him and I am assuming there was no type of contract. Always have a contract!!! You do have the obligation to take him to court. I also assume he rode the bike prior to making the deal and had no prior complaints about the performance. It's worth a try to take him to court, but remember, it's your word against his. A witness to the transaction would be beneficial if you had one.
