I sold my car for 1000 dollars and was promised(on paper) to receive 200 dollars more when I received my title in the mail (specific date on paperwork) Problem is my title was lost in the mail and is now taking weeks and weeks to come. In the meantime they are driving my car around under my name, any accidents or traffic slip ups will be at my fault. What can I do???

  1. I really don't understand how come you sold your car when you didn't have the title. You should wait it before you sold. The only thing you can do, just wait from DMV now and call and tell them you already sold the car. Explain the situation to them, and let see what they tell you.

  2. You sold them a car so that is what they get,a car.Take your license plates back if they are using them, then you are not liable for their actions. The rest can be handled later.

  3. Protect yourself. Go to the DMV, fill out a "Transfer of Liability" form and have the other party sign it too. Then the DMV can record that a transfer of liability has taken place with the stipulation that a "Transfer Of Ownership" will occur once the title is finally sent to you so you can sign off on it.

This will release you from any responsibility should something happen to your car while the other people drive it. It covers tickets, accidents or crimes such as fleeing or hit-and-run. In many states you can also transfer the registration since you've already applied for the title. This will give you even more release of responsibility. Check with your local DMV on this.
