Question:

I think we may be about to split and i'm not sure what i am entitled to. We bought a house 9months ago?

it was bought in his name. We decided on who was going to pay what as in i paid for food, stuff for the house and a bigger part of going out and he paid the bills. Neither of us have lived in the house full time as we spent half the week there and the other half at my parents which is where all my post goes to. We both put money in as a deposit most of my share i borrowed from family. Now he expects me to just walk away if it ends. What can i do? We have been together for just over 5 years.

  1. I am sorry you have to go such an ordeal after 5 years.  What was the agreement you made prior to purchasing the house? The money you borrowed from our parents? Was this documented by check or bank withdrawal.  It depends on the laws in the state you live.  Some states do not recognize common law marriages.  But if you can document some type of agreements even if they were verbal you should be able to at least get your money back.  As hard as it might be, you need to be able to prepare yourself to walk away from ordeal and learn from the experience.

Well. . . if you live in the United States. . .you're. . .pretty much. . .SCR*WED!!!!!!!!!!   If you had LIVED TOGETHER for at least 7yrs. you would be entitled to SOMETHING by COMMON LAW MARRIAGE.  But, since the house was put solely in HIS name (BIG MISTAKE, BY THE WAY) without a clear stipulation of who gets what percentage (like Tenants in Common), you have no basis for any claims.  Had you taken the property by TENANTS OF THE ENTIRETY, you would be entitled to an equal division with full right of survivorship; depending on what STATE you live in, that "full right of survivorship MAY have to actually be stated!

    But. . .in the future. . . DON'T EVER JUST PUT EVERYTHING IN YOUR SPOUSE'S NAME!!!!!!!!!!!!!!!!!!!

  4. This is too hard to answer, the laws in each state are different, see if a divorce lawyer will give you a free consultation or look on line for laws in your state...
