I have a roommate house and I want her out. We never had a lease agreement or even nothing in writing. She has a flat fee of $500 for 2 weeks. If she stays longer than 2 weeks she will have to pay for the extra days. She agree to that. Now she over 16 days and will not pay. We tried to talk to her but she keeps avoinding us. We sent her a 30 days notice to leave but since we don't have a lease agreement. Does that still apply? Also I have my stuff in that room. I want it back. Can I just go in there and get it out?

Can I just kick her out?

  1. Like it or not you had a verbal agreement making her a tenant so you have to evict her.  Just follow the eviction process for your area and eventually you will get rid of her.  You can charge her for rent for all the time she was there (but it may be tough to get it).
