I want to change my answer in small calims court?

I submitted an answer to the clerk of courts because i am being sued... I want to change my answer now and admit to owing the money, but i need to set up payment plans. can i just say that at the court date? or do i have to go to the court house like last time?

  1. You can do it on your court date.  Call the lawyer representing the creditor.  See if you can work something out before the court date and you can avoid going.


  2. If you can do it privately and reach an agreement before the court date the plaintiff can dismiss the suit and keep a judgement off your record. Call the other guys lawyer.

  3. If you go to court there are probably going to be some other reprecussions because you lied on your answer to the court.  Its call purjury.  It is a federal offense.  You certainly dont lie to the court.

    Check with attorney (if there is one) or the landlord and see if you can make payments.  If not, then you may have more problems then you thought.
