  1. Without preaching to you about whether or not to file.....

If you file Chapter 13 the payments are "rolled" into your payment plan and you pay them over 3 years.

If you are going to file Chapter 7, you will need at least $1500 depending on where you live and how complicated it is.  Quit paying all of your bills and wait for them to start piling on judgments.  Then you file with the money you saved from not paying the bills.

  2. Depends: Are you seeking a Chapter 7 bankruptcy, or Chapter 13 bankruptcy?

If there's any possible way you can settle your debts without filing for bankruptcy, then do so. This is a major blemish to your credit worthiness and you'll find yourself a slave to your credit score for many many years to come.

This is not something you want to move on without have all the knowledge possible. Be very careful with this decision.

  3. If you are considering bankruptcy, talk to an atorney.  They usually will give you a free consultation to determine if you qualify.
