I want to get rid of my Roommates who just moved in, easiest way ?

I was trying to sell my house but 3 deals fell thru because people couldnt get financing... I dont have much equity in it, just about 30,000 (after paying all kinds of fees, transfer taxes, real estate lawyer, etc)

Wel since it wouldnt sell i just got three roommates. They each have their own bedroom and are playing a really cheap rent for access to the huge kitchen, yard, deck and parking... nice deal

All guys .... 2 of the 3 want to only be month to month and KNOW Im still trying to sell. The 3rd guy seems totally clueless.

I told him it was month to month and ALSO that i have cats before he moved in .......Now that he has moved in he is treating my house like HIS OWN. He is a teacher BUT works around the corner.... So now he keeps coming here all day long. I work at home and he wont stop pestering me with stupid question. Ive tried to be polite and gave him long list answerign questions.... Now today he is whining that he has cat allergies and can i keep my cats in the cellar!

And he has use dmy private bathroom, my dishes and my pots and pans and a special condiment i never use (29.99 trufflke sea salt that was a gift from a dear friend)

Ive tried to finally tell him groundrules.... All he says is okay...

I now have an offer today for my hous e! From someone who love dit last month!

I want out !

Whats the best way to get rid of them ?

30 days notice? im afraid the 3rd roomie/boarder will flip out because he said he is in love with this house and so happy here

  1. If your name is on the deed, it's your home, and you are running a boarding house, not an apartment.  Do it the nice way, give them a written and verbal 30 day notice showing your intent to prepare the property for a sale, and if they don't move, get the party(ies) evicted before they damage your home.  By the sounds of your story they don't have written lease agreements and probably haven't provided you with any security deposits either.  Grow up and protect your interests.  Sure they are all in the love with the house -- the deal, not the house, and if you ever rent out rooms again, do it properly in writing and protect your interests as these three are only interested in themselves.  Good luck in your sale, and don't move out and disconnect utilities until the papers are signed and the buyer's money is in YOUR bank account.  $30K in equity is not a toy to throw away.


  2. You have to give them a 30 day notice in writing. Then you can call the sheriff to evict them.

  3. The easiest way, although dishonest, would be to tell them you have a very potential buyer in the near future and tell them they need to go ahead and make arrangements now. At least this way, there's no hard feelings like there would be just throwing them out because you don't like them, and your avoiding potential damage to your home. Alot of people would tear up rental property if they get angry with the landlord.

  4. Well they understood that you were still trying to sell your house. This shouldn't be a problem. Just give them a 30 day notice in writing as well as verbally.. they are adults and should act like so by leaving respectively

  8. Do you have a contract with any of these people?

    f not, tell them they have to move out by the end of the month. Tell them all, type it up and serve them all with their NOTICE to leave.

    If you have a "lease contract" with them, what did you stipulate as far as them giving you notice? 30 days? 10 days, that is just the same for you, and again just give them all proper paper notices and tell them when they have to be out by.

    If they start griping about you can't do this. Yes you can. This is your personal home, you can call the police if need be and have them all removed.

  10. Get rid of #3 with written notice right away. I would tell him you sold the house and they want it empty, avoid anything of a personal attack.

  11. When you rented the room to this person, you became a lessor, he became a lessee, and you are both bound by the landlord-tenant laws of your state.

    First and formost, you cannot change the locks and remove his property. That would expose you to civil liability and possibly also criminal liability. To remove him, you have to follow Unlawful Detainer procedures. You would have to serve him a written Notice to Quit, most likely a 30 day notice, but that may vary by state. If he does not move after the 30 days are up, you then have to file an Unlawful Detainer lawsuit. Only when you have prevailed on the lawsuit and have a Judgment against him, can the sheriff or marshal execute a writ and physically remove him.

    A couple of other points. When you rent a room in your home, unless that room has bath room and kitchen facilities and it is specificallly stated in the rental agreement that the renter has access to no other part of the home but his room, you cannot rent out a room and restrict him from using the common areas of the house. (That doesn't mean he can eat your food, though.) Also, though most rent control ordinances do not apply to single family residences, you should check and see if there is a local rent control ordinance that does apply to you. If so, you would need actual cause to evict a tenant, and nothing you described would be actual legal cause for an eviction.
