  1. Each state can pass anti-smoking laws outlawing smoking in public places or outlawing smoking in certain establishments.  A town or county (a subdivision of a state) can outlaw smoking in establishments within their jurisdiction.    As far as I know, no state has passed ordinances outlawing smoking outdoors except around flammable liquids or gases.

    Each property owner or business can restrict smoking on their property.


  2. There are a lot of different regulations. It depends where you live, because the laws are mainly controlled by individual states and cities or towns. Throughout the country the legal age to buy cigarettes is 18. It is illegal to buy cigarettes for someone under 18.

    The federal government bans smoking in almost all areas of government buildings, there are a few exceptions I think but they are rare. It is generally allowed to smoke outside those buildings but they may have rules about how close to entries or air vents you can be, etc.

    States can pass their own laws about where smoking is allowed. Most states ban smoking in government buildings and inside buildings like hospitals, bus stations, airports, etc. Some states still allow smoking in restaurants and bars, but a city in a state that allows smoking there can still pass their own restrictions to prevent it within city limits/ borders.

    Since there are so many different branches of government that control the laws, there are a ton of variations.
