I want to live in the condo that I'm currently renting out...?

I'm in Toronto, Ontario, Canada, and I am currently renting my one-bedroom condo. The lease agreement we signed is for one year and will end in December.

My question is this:

Am I allowed to "kick her out" (with 60-day notice according to Ontario Residential Tenancies Act, 2006 http://www.ontariotenants.ca/law/act.phtml ) before the end of the lease term? I would really like to move there in 2 months (60 days), but am not sure if it's lawful of me to ask her to leave for no other reason than the fact that I want to live there instead.

I read the Act (in the link above), and there definitely is guidance, but I'm getting super confused. Could someone read it and tell me your interpretation of the Act on this matter?

  1. You will not be able to move into the condo until December.  

    You will have to give her the 60 day notice, so that she is aware that the lease will not be renewed.

    Your other option is to create a new agreement between the two of you.  You could offer to pay her moving expenses, and maybe an additional amount of cash as incentive.

    You can never "kick someone out" without cause.

I'm not going to attempt to read all that legaleze, but where I am (in the USA) you cannot terminate a tenancy early unless you have a special clause for this in the lease agreement (and these clauses usually related to selling the place not moving in yourself, so even this would not help you) or the tenant breaks the agreement in some way.

    So, I think you are going to have to wait until December.  Note that you could offer the tenant some money just to leave now (a free months rent, or something).  Maybe they would take you up on it.
