I want to make my husband a resident of the U.S. how can I?

my husband is from Mexico he came to the U.S. illegaly how do I start the prosses of making him a resident (legal)? Does he have to leave the country? how long does it take? We have been married for 2 years.

  1. Consult with an immigration lawyer.  They have been able to make illegals legal.

    If you are you could petion him for his green card.

    If he enter the USA with a visa you wont get penalties.

    If he enter the USA illegal you might pay some penalties.

There is no way to "legalize" an illegal alien, not even through marriage.  He must leave the US, and you cannot file an application for a spousal visa until he completes the period for which he is barred from re-entry.  Since he has been here illegally for so long, he will be barred for 10 years.

    If you try to get him a spousal visa after 10 years of separation, it is going to be extremely difficult to prove a valid marriage.  If you want to stay together, upon his return to Mexico, he can apply for your immigration to Mexico.
