I want to now if it is considered kidnapping or not in ohio if the non-custodial parent hides or runs with kid

Im the father took my kids for there visit with mother for summer had some things happen that I ended up getting my daughter back early well the mother grabed my daughter by the neck and held her down to take cellphone i had bought her to call me with and gave it away to a friend and police said it wasnt abuse just disiplen and couldnt do anything but I had to live my nine year old there for his visit I told the police I was worred about her running and said I had no choice because of the courtordered visit well her visit wa up the 13 of this mounth went to get him and took police with me but she was know where to be found tried to get the police to look for him but said they couldnt do anything asked if I could fill kidnapping charges on her and was told no its not kidnapping since we were married at one time Im divorced and have full cust. but dosnt seem to matter to the police in ohio

  2. usually the noncust. parent cannot take the child out of state without the consent of the custodial parent. You need to talk to a lawyer and get something in writing.

  4. I live in Ohio. As far as I was told, if I, the custodial parent with full custody wanted to move to another state, it was ok. My lawyer told me this, and also said that my ex would not be able to do anything about it. I had decided to stay anyway. Just to avoid the drama. Mostly he said, if I was moving due to a job, there was absolutely nothing that he could do. I'm not sure about ur situation, but if you have access to free legal advice take it and tell them the entire situation, only they can really tell u for sure. I had trouble with Ohio police enforcing the restraining order I had on him, they didn't seem to wanna be bothered, so I have my own axe to pick with Ohio law enforcement officers. Hope this helps a bit. Ask a lawyer or visit a website that deals with family or domestic law, maybe even contact your congressman.

  7. You should get in contact with Child Protection Services (CPS). Show them that you have court ordered documents stating that you have full custody and that your ex-wife took your daughter and ran. If she is nowhere to be found, it is possible they will put out an AMBER ALERT. You might want to think of going for full custody with supervised visitation because of this and if that doesnt work, then go for full custody with no visitation. Dont be suprised if your ex gets arrested due to the CPS investigation. Be careful.

  8. It is kidnapping.they are going to tell you you have to file with the courts again. I know its bullsht. I am in the same boat you are. Any time my ex has visitation with my kids I am always worried she will run. Sorry to hear yours has actually done it. I have custody of my kids and its rare for us dads to get that. We go through so much BS with law enforcement that its unbelievable. I hope you get your boy back unharmed.

I am a divorced parent with sole physical custody.  And i do know that during a visit the non custodial parent can take the kids where ever they choose to.  HOWEVER once the visit is up and they do not return child that is kidnapping.  My ex husband tried to do this.  I had to get a hold of dhs tho to do any good.  I called and filed a report and dhs called the cops.  I am sorry you have to go through this.  I hope you get your children back where they belong.

  11. Get a lawyer and get this filed immediately. The judge can issue a warrant for her arrest.  Unless you had a previous history of domestic violence, the judge would ordinarily issue the warrant.   If you have anything with her social security number on it, you can also find her using credit reports.

    I've heard a lot of complaints about Ohio police not enforcing court orders.
