my sons father hasnt wanted anthing to do with him in 3 years hes 3,i live in flordia,and i want to marry my boyfriend,who lives in connectcuitt,i recently found out now that my sons father is ordered to pay child support ,he wants to take him completely away from me,and me pay him,he has been arrested many of times ,married many of times,he has a slimy lawyer and i never got served any papers,i found out ,i guess you can say by luck and made it to A pre trial confernce

    Chances are, if your record is clean and his isn't you will get to keep him.

    However, if you want child support, you may have to give visitation. If you HAVE to do that and you live out of state, it may be his responsibility to pay for transportation... but do you trust him not to take your kid and run?

  4. Trust me on this, my biological mother, who lives in Florida, wanted custody back from me. My grandmother and I live in Connecticut, and she had temporary custody of me.

    Long story short, she took me back to court and the judge said absolutely not. My mother has served in prison numerous times; she prostituted; and she never paid child support. I, at 17, was lucky enough to be of age to testify.

    But your son is 3, and you need to be the voice for him. You can't in any way let this man who hasn't been there for your son to take him from you. You cared for him and raised him since he was a child, and he has no right to have custody of your child.

    Take this man to court, and let him have it!

  6. Without a custody order,either parent can take their child anywhere they wish legally so you are free to make your move.

    Unless you are a complete mess of a mother(I'm talking neglectful junkie type here),there's no way a court will grant custody to him especially with an arrest record. Keep in contact with the court he's going through to keep dibs on what he's doing legal wise where your child is concerned and if you find there is a hearing,you can appear by phone, that shows you are cooperating and want to resolve the issue. If there is no court order just leave.  do not tell your sons dad you are going or any one who may tell him you are going.  Once it goes to court you will not be able to leave.  in most states it does not matter if a father had nothing to do with a child for 10 years if and when this man decieds to be the childs father the courts will give him all his rights as a parent.  the court systems are so screwed up they are surpose to put the best intrest of the child first. but they don't.  they will force your child to see this man that they don't even know.  get out while you can before the courts get involved.

    My best friend fled the state with her children. She left after her abusive husband,who already had numerous police reports on him,tried to hit one of her children with a shovel. After he found out she left the state,he immediately went to court and got a custody order,since neither of them had one. She had to return with her children. After years of court hearings,she lost custody of both of her children to this abuser. He had a slimy lawyer too. It was always used against her that she left the state and deprived the father of his children. She had to have supervised visits because they said she was a flight risk. She was trying to protect her children and ended up losing them because she left without his permission.

    Strange things happen in court,things that should never happen.

    Do it the right way,go to court,get custody and the permission of the judge to leave state. If you can show the child would have a better life if you moved to get married,you should have no problem. It could save you from a nightmare down the road.
