Question:

I want to renew a restraining order against my ex but what if I don't know where he lives?

The restraining order is for domestic violence and it expires next year. I was told if I can't get him served I wont be able to get another restraining order. Note: We have a daughter together whom he is not aloud to see. The stay away order would be not only for my protection, but for my family's as well.

  2. Do you know where he works?  Unless the restraining order lists yourself and family members, it is only valid on yourself.  You may need to go to family court to make sure make sure you are given sole custody and your daughter is also granted a restraining order.

  3. i had the same problem in having my ex served. i had no address for him and it turned out he was living in his car. they could not catch up to him at work either. they ended up serving him in court while he was there for a dui hearing. my case against was continued until he was served.

       This one is easy. You just go to the court who originally issued the order. Apply for a new one. Then pay the court the small service fee. The court will have a process server, whose job it is to locate people, and serve them. Also, if the subject comes by your residence, call the police and have no contact with the person, until the police arrive. They can serve orders of protection right then and there, assuming you have a copy of the order with you..

  5. It really depends on what state you are in. Was it a criminal or civil restraining order? I am assuming it is civil since you want to renew it. In California, you can renew a restraining order without first serving, but you would need to serve after the fact. So what I always tell my clients is give a copy to everyone that lives around you...his family..mutual friends, and when they see him they can serve him with it. (And of course then fill out the proof of service and turn into the court) A lot of times the judge will give you an extension to serve if you are showing an effort to serve him.
