I want to settle a debt. What should I know before I do this? Should I contact the attorneys office and let them know or should I write them a letter?I really need some advice.

  1. What you didn't mention is the current state of this debt.  Are you in "arrears" or have you been making monthly payments?

    Judging by your speak I would guess that you haven't made any payments and you want to settle it now.  Contacting a lawyer can be expensive, if you have the money, check internet reviews and go for the best lawyer on credit counseling.  If you can't afford it, you can check the internet for credit lawyers that offer free counsel.  Many metropolitan areas have lawyers that offer free services.  

    Another way would be to get a copy of your credit report.  You are allowed 3 free ones per 12 month period from the big financial reporting agencies.  www.annualcreditreport.com/  www.freecreditreport.com/

    They usually include information on contacting a debtor to pay off a debt.

    Now once its paid you have to follow up on it and make sure that the debtor removes it from your record.  Typically they would have that information.  It's up to you to follow up on it.  It's important.


  2. contract the creditor as tell them your interested in settling.  and, ask if they offer a discount if you pay it all immediately.  Some creditors will take as much as 50% off to get the debt settled.

  3. yes contact the office and get the settlement figure in writing FIRST. Never give them access to your checking account. Once in writing pay it in full if you can if not make sure the terms are in your letter. Pay by money order and keep the stub as you may need it as proof. Once paid wait till the 15 of the following month and check your credit to make sure they posted it as settled account. If not dispute the reporting with your supporting documentation and it will get corrected.
