I want to sign my rights over do. do i have to have her permission to do that?

im fixing to go to court for child support. Im married with two kids and support the family. The other woman taking me to court has a three year old son by me ( i think). i want to sign my rights over point blank! Will i have to pay back-child support and can she stop me from signing my rights over?

  1. I believe it will be up to your court's decision. They will make sure there is a paternity test done as well for your well being. If that is what you want to do I hope it turns out well for you. I had my baby's father sign a parental rights wavier.. I can't get money from him at all and he doesn't have any rights to see it either.. It worked out best for me.


  2. Well I don't understand why you would want to sign over your rights to your other son in the first place. Do you know what that will do to your kid? Knowing that you're off somewhere rasing 2 other children by another woman but you gave him up? Thats your kid, why wouldn't you want him? It sounds like you're a pretty selfish guy, you don't want your kid, and now you're worried about paying back child support? You should be there for your son because he is your responsibility. Just because it might be trouble doesn't mean you should sign away your rights, and if I were your wife that would be a huge red flag to me!! what if you divorce her, and find some other woman are you just going to sign off your rights to those kids? really think about what you're doing

    The first thing you need to do is request a paternity test.  If the child is proven to be yours….

    A parent can’t just sign over their parental rights. Termination of parental rights has to be approved by a judge, and generally speaking they will not allow it unless it's for the purpose of adoption (ie if Mom has married and her new hubby wants to adopt the child, but I don't assume that's the case since she's requesting child support).  

    If people could sign away parental rights just to avoid child support, they would be lined up to do it, and the welfare system would be overwhelmed (and it already is) with the need for the taxpayers to support the children of parents who don’t want to be bothered with supporting the children that they helped to create.   The taxpayers don’t want to, nor should they have to, support YOUR child.  

    With that said, you can give up custodial and/or visitation rights (which is a different thing than parental rights) but you’ll still have to support the child.  In my personal opinion, turning your back on your own flesh and blood (ie refusing to be a part of their life) because you ‘don’t want them’ makes you a class A jerk, but sadly there are plenty of jerks out there who have done it.

  5. she can't stop you from giving up your parental rights.  whether you will have to pay back child support however is up to the judge.

It sounds like you aren't even sure this child is yours.  Ask the Court to order a DNA test to legally establish who the father is.  Signing your rights over is not a way to dump the responsibility for your child.  Parents do not get to divorce their children, particularly when the motive behind doing so is to save themselves money and stick the taxpayer with the costs of their children.  Situations like this are why there are so many ads promoting condoms as the smart thing to do.

    If it is your boy, I pray to God that you face your responsibilities and be a good father to ALL of your children.
